NOTICE OF MORTGAGE FORECLOSURE SALE
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. THE DEBTOR'S RIGHT TO OBTAIN VERIFICATION OF THE DEBT AND THE IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PERMITTED BY LAW IS NOT AFFECTED BY THIS ACTION.
NOTICE IS HEREBY GIVEN, that default has occurred in the conditions of that certain Mortgage dated December 18, 2019, executed by Chad Sachs, a single person, as Mortgagor, and Concorde Bank, as Mortgagee, filed for registration in the office of the County Recorder in and for the County of Swift, State of Minnesota, on December 23, 2019, and memorialized as Document No. 249648.
1. The original principal amount secured by the mortgage was $42,500.00.
2. No mortgagors have been released from financial obligation on the mortgage. No action or proceeding has been instituted by law to recover the debt secured by the mortgage, or any part thereof. A default has occurred by which power to sell under the terms of the mortgage has become operative.
3. There is due and claimed to be due upon the mortgage as on the date of the Notice, the amount of $42,500.00.
4. All conditions precedent to foreclosure of the mortgage and acceleration of the debt secured thereby have been fulfilled. Prior to commencement of this mortgage foreclosure proceeding Mortgagee complied with all notice requirements by statute; and no action or proceeding has been instituted at law or otherwise to recover the debt secured by the mortgage or any part thereof.
5. Pursuant to the power of sale contained in the mortgage, the mortgage will be foreclosed and the real property located in the City of Appleton, Swift County, State of Minnesota, described as follows:
Lots 3 and 4, Block 15, Severance's Fifth Addition to the City of Appleton, according to the map or plat thereof on file or of record in the Office of the County Recorder in and
for Swift County, Minnesota,
will be sold by the Sheriff of Swift County at public auction on March 25, 2021, at 10:00 a.m. at the Sheriff’s office in the City of Benson, Swift County, State of Minnesota, to pay the debt then secured by the mortgage, and taxes, if any, on the premises, and the costs, attorney's fees and disbursements allowed by law.
6. That property is located at 328 East Schlieman Avenue, Appleton, MN, and is identified by tax parcel identification no. 22-0569-000. The name of the lender is Concorde Bank.
7. The time allowed by law for redemption by the mortgagor, their personal representatives or assigns is six (6) months from the date of the sale.
8. The time required to publish the notice by advertisement is six (6) full weeks, at least 42 days from first publication to date of sale, in a qualified legal newspaper in the county where the mortgaged property, or some part, is located.
9. DATE AND TIME MORTGAGOR MUST VACATE THE PREMISES: Unless the mortgage is reinstated or the property redeemed, or unless the time for redemption is reduced by judicial order, you must vacate the premises by September 25, 2021, at 11:59 p.m., or the next business day if that date falls on a Saturday, Sunday or legal holiday.
10. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
